Success Stories: Case Study 1 Assessment - Rectification
The relocation of a division of a major government ministry was mandated to create job opportunities in a regional area. A project health-check was requested to assess progress of the $6 million program of works. Ashby Bachmann identified a number of opportunities to improve governance, including resolution of a detrimental personality conflict amongst critical stakeholders.
A follow-up health-check revealed a technical impediment which was jeopardising the politically sensitive on-time delivery. We proposed both a short-term solution and longer-term remediation which met the diverse goals of all of the stakeholders.
The relocation occurred on time and met the social, political and organisation objectives of the project.
Case Study 2 Strategy - Over-Sight
An entrepreneurial services organisation recognised the need to upgrade its technology and systems. Its current vendor displayed reluctance to undertake the upgrade. Ashby Bachmann presented recommendations for a new solution and a new vendor to implement it on a fixed price basis. We also undertook the over-sight process to ensure collaboration between the former and new vendor and the client.
Despite several technology challenges and business evolution in the client€™s marketplace, the solution was deployed on budget. Additional functionality was added through a structured program of releases during the following eighteen months, at fair time and material rates.
The vendor obtained an enthusiastic and profitable reference site for its services while the client received a state of the art solution which gave them a sustainable competitive advantage.
The client subsequently acquired a new business and retained Ashby Bachmann to oversight vendor selection, negotiation and project progress.
Case Study 3 Assessment - Mediation
A global mandate to develop a new image processing product was falling behind schedule. The client was considering cancelling the contract with the software developer to pursue a different course. Ashby Bachmann was called in to ensure that the current software source was in escrow and to assess the situation.
We determined that the major impediment to timely completion was the interface between the client and the developer. The client nominated a new liaison and work continued.
The product was delivered on time for its major annual market opportunity and developed early lead advantage in the marketplace. The software developer continues to provide enhancements to keep the product at the leading edge.
Case Study 4 Assessment and Termination
A national telecommunications provider had contracted for out-sourced services of its entire business systems facilities. Development and delivery were behind schedule, costs were mounting and there were numerous disagreements over contracted deliverables between the project managers for the client and the vendor. Ashby Bachmann was requested to assess the situation by the client. The vendor declined to accept suggestions to resolve the delays and to achieve solution development. We defined reasonable ground for contract termination.
The grounds were presented to the vendor who agreed to contract termination with no compensation. Under oversight and governance by Ashby Bachmann an alternative successful solution was achieved.
Case Study 5 Litigation Support
A government agency terminated a Y2K project under a ‘failure to deliver€™ clause and sued the vendor for recovery of costs. Ashby Bachmann was engaged to evaluate the vendor€™s project performance and its contribution to the failure.
We identified a well documented series of inadequate project governance processes on the part of the vendor. We also identified a cynical lack of transparency in the reporting of issues critical and relevant to the client. The findings created a strong case of vendor culpability for the contract failures.
The vendor made an out of court settlement in favour of the agency.
The situation exemplifies the benefits of sound governance processes from project inception, through contract negotiations and throughout the life of the project.
Case Study 6 Litigation Support
A major international solutions vendor terminated its fixed price contract with a government agency after four years of work, claiming dramatic changes of scope. Claims and counter-claims amounted to some $80 million. The agency retained Ashby Bachmann to assess the project governance performance of the vendor and its claim of scope creep.
We identified a chronic history of failures of good governance practices by the vendor and evidence that the vendor had advocated many of the scope changes themselves.
The claims were settled out of court.
The early indications of project jeopardy could have been identified much earlier by an objective governance oversight process.
