Elements of community consultation involves; providing notice, allowing time for a response, listening to the response, considering the response, reporting back. Each step is a process and deliberate and must be meaningful in its delivery.
This approach is an effective strategy used by all Government departments respecting consultations with First Nations and Métis in circumstances where action contemplated by Government may adversely affect Treaty or Aboriginal rights. It is intended to assist departments in the development of their own procedures that take into consideration their unique needs. Officials should speak directly with their solicitors if questions arise respecting the application of this process.
The Supreme Court of Canada has said many times that aboriginal peoples must be consulted properly about the effects on their aboriginal and Treaty rights. The Anishinabe Nation in Treaty # 3 and other Political Tribal Organizations have developed a law that provides an easy way to do this. A.J. Doxtdator also understands how to form understandings between Government and First Nations.
These guidelines are intended to reflect, in a practical way, the minimum legal requirements established by the courts. These guidelines are not intended to replace or supersede internal policies and practices providing direction on consultations, the development of partnerships, co-management arrangements or other working relationships between the Government of and First Nations or Métis.

The Courts have noted that, at all stages in the consultation process, good faith on both sides is required. The government€™s intention at all times must be to address the concerns as they are raised through a process of meaningful consultation. However, the Courts have also noted that there is no duty to agree. Rather, the commitment is to a meaningful process of consultation.
In all situations, the controlling question is what is required to maintain the honor of the Crown and to effect reconciliation between the Crown and the First Nations and Métis people with respect to the interests at stake.
Key / Major Clients: Mr. Jim Doxtdator is a First Nations member of the Six Nations of the Grand, Oneida Nation; Wolf Clan. He received his civil engineering diploma from Mohawk College in Hamilton, Ontario in 1992 and has worked with The Ministry of Transportation of Ontario, Public Works Government Services Canada, Indian and Northern Affairs Canada and the Ontario First Nations Technical Services Corporation.
Mr. Jim Doxtdator is currently the principle at A.J. Doxtdator - Associates. Jim offers a wide range of programs and services to First Nations and Industry; from Professional Project Management, Community and Industry Consultation and Accommodation, advising First Nations on Housing and Environmental issues. Within these issues Jim offers policy development, corporate education awareness training, funding proposals and political advisory services.
Jim was responsible for housing advisory services and housing related training to Tribal Councils and Unaffiliated First Nations at the Ontario First Nations Technical Services Corporation (OFNTSC).
Jim holds certification in R2000 and Energuide through NRCan as well as certification through HRAI in Heat Loss Heat Gain, Ventilation Design, and Ventilation Installation. Jim is also a certified engineering technician affiliated with OACETT.
During his tenure at the OFNTSC Jim was the Ontario Technician on the Assembly of First Nations, Chiefs Committee on Housing and Infrastructure (AFN CCoHI). Jim was responsible for reporting to the Chiefs in Assembly in Ontario as well as advising leadership on direction as it pertained to National and Regional housing issues.
Jim was a member of the CMHC/INAC Allocation working group (AWG) and member of the Federal Liaison Committee. Jim was instrumental on the formation of the First Nations Building Officials Association of Ontario, and the National First Nations Housing Manager Association.
Jim has vast experience in effective communication with various levels of government and First Nation leadership.
Jim has a strong understanding Nation to Nation relationship that First Nations work towards. Jim also understands the dynamics of Regional, Treaty and local levels of First Nations Governments. Jim€™s approach to projects is to strengthen First Nation Governance and build capacity for the next seven generations.
